Title of Laws, Regulations, or Judiciary Interpretation: Details of Implementation of Automatic Import Permit Control of Major Industrial Products Promulgating Organ: The State Economic & Trade Commission, The General Administration of Customs Date of Promulgation: Jan 15, 2002 Date of Implementation: Feb 1, 2002 Applicable Scope: These details are not applicable for the following situations: The State implements control on import ban; the State implements control on restricted amount of import; materials supplied by overseas or import under processed items of imported materials (except for crude oil); imports by bonded areas and export process districts of the People's Republic of China; and other import conducts stipulated by the laws and administrative regulations. Major Contents: The State Economic & Trade Commission of the People's Republic of China is responsible for the formulation of major industrial product catalog of automatic import and the statistics, analysis and surveillance towards automatically imported products. Economic & Trade Commissions of various provinces, autonomous zones, municipalities directly under the State Council and the of single listed cities authorized by the State Economic & Trade Commission and the Administrative control organizations designated by relevant authorities of the State Council will be responsible for the control of automatic approval of major industrial products in their respective areas and departments. These details stipulate the surveillance procedures and procedures of automatic import approval. Banks will sell foreign exchange by inspection and release according to the "Certificate of Automatic Import Permit for Major Industrial Products"; Customs will inspect and release according to the "Certificate of Automatic Import Permit for Major Industrial Products". Whereas major disputes may occur in the process of registration, the State Economic & Trade Commission will be responsible for coordination or arbitration. Whereas coordination or arbitration may not be convincing, then administrative reconsideration or administrative litigation may be brought forth according to law.
