Regulations on the Guidance for Investment Direction of Foreign Businessmen
Title of Laws, Regulations, or Judiciary Interpretation: Regulations on the Guidance for Investment Direction of Foreign Businessmen Promulgating Organ: The State Council Date of Promulgation: Feb 11, 2002 Date of Implementation: Apr 1, 2002 Applicable Scope: Applicable on projects and other forms of foreign-funded investment projects by Sino-foreign joint ventures, Sino-foreign partnership and foreign-funded enterprises invested and established within the territory of the People's Republic of China. These regulations are to be referred to for the investment projects organized by Overseas Chinese, Hong Kong Special Administrative Region, Macau Special Administrative Region and Taiwan Region. Major Contents: Relevant departments of the State Council will be responsible for the formulation of "Guiding Catalog for Investment by Foreign Businessmen in Industries" and "Catalog of Investment Advantage Industry by Foreign Businessmen in the Mid and West Regions", making it basis for the guidance, examination and approval of investment projects by foreign businessmen and relevant applicable policies for foreign businessmen and investment enterprises". Investment projects by foreign businessmen are divided in encouraged, permitted, restricted and forbidden types. It also stipulates the conditions for investment projects by foreign businessmen that are entitled to favorable policies. These regulations stipulate the authority of examination and approval and filing works of relevant government authorities. Regarding investment projects by foreign businessmen involving quota and certificate of approval, these regulations stipulate that application of quota and certificate of approval must first be obtained from the Foreign Economic and Trade authorities. This document finally stipulates the rules for punishment.
